Terms of Service

By accessing or using MyFertility Report, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, which forms part of these Terms.

MyFertility Report is an AI-assisted service designed to help users understand fertility-related topics and organize information for discussion with qualified healthcare professionals.

Fertilia, our AI assistant, and the reports generated through the Service are intended for informational and educational purposes.

Certain features require an account. You must be at least 18 years old to register and you are responsible for maintaining the confidentiality of your account credentials.

You agree to provide accurate, current, and complete information and to promptly update it when it changes. You must notify us if you suspect unauthorized use of your account.

You may use the Service only for lawful purposes and in compliance with these Terms. You may not use the Service to:

• Violate any applicable law or regulation.
• Infringe the intellectual property, privacy, or other rights of others.
• Upload, transmit, or distribute harmful, abusive, deceptive, or unlawful content.
• Attempt to disrupt, probe, reverse engineer, or gain unauthorized access to the Service or related systems.
• Introduce malware or other harmful code.
• Impersonate another person or misrepresent your affiliation.
• Use the Service for spam, phishing, or other unsolicited communications.

• Our technology: Smart Reports LLC owns the Service, including the Fertilia assistant, software, interfaces, branding, and related intellectual property, except where third-party rights apply.
• Your submitted content: You retain ownership of the information you submit. However, you grant us a limited, non-exclusive, worldwide, royalty-free, revocable license to use, process, store, and analyze that information to operate the Service, generate your reports, support your account, and improve our systems, including through de-identified and aggregated use as described in the Privacy Policy.
• Feedback: If you share ideas, suggestions, or feedback about the Service, you grant us a non-exclusive, worldwide, royalty-free license to use that feedback for business purposes without compensation to you.

Your use of the Service is also governed by our Privacy Policy. In summary:

• We collect account information such as your email address and authentication details, and may collect your name when you provide it or when a referral workflow requires it.
• We process fertility assessment answers, report content, support communications, and limited technical usage data in order to run, secure, and improve the Service.
• Payment card data is handled by our payment provider rather than being stored on our own servers.
• If you participate in an eligible specialist referral workflow and consent to report sharing, we may send the relevant report copy to the referring doctor or clinic.

MYFERTILITY REPORT IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART REPORTS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART REPORTS LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) $100 USD.

Termination by you: You may stop using the Service and delete your account at any time. If you need guidance, you can review the how it works page.

Termination by us: We may suspend or terminate access if you violate these Terms, create legal or security risk, or if we need to discontinue the Service.

After termination: Your right to use the Service ends immediately. We may retain certain information as described in the Privacy Policy.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules.

Subject to the dispute resolution section below, you agree that disputes arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

If you have a concern about the Service, please contact us first at support@mysmartreports.app so we can try to resolve the issue informally.

If a dispute cannot be resolved informally, you and Smart Reports LLC agree to resolve eligible disputes through binding arbitration administered by the American Arbitration Association under its applicable rules, unless applicable law requires otherwise.

By agreeing to these Terms, you may be waiving the right to bring claims in court or to participate in a jury trial, to the extent permitted by law.

We may update these Terms from time to time. If we make a material change, we will use reasonable efforts to give advance notice where appropriate, including by posting a notice in the Service or sending an email to the address associated with your account.

By continuing to use the Service after updated Terms become effective, you agree to the revised Terms.

• AI reports are informational only. Reports and chat responses are designed to support education and discussion, not to diagnose, treat, or replace a licensed clinician.
• AI outputs may be incomplete or incorrect. Like any AI system, Fertilia may produce content that is inaccurate, incomplete, biased, or outdated.
• Clinical review remains essential. You should review any report or recommendation with a qualified healthcare professional before acting on it.
• No guaranteed outcomes. We cannot promise any fertility, treatment, or health outcome from use of the Service.
• Automation and ongoing changes. The Service is largely automated, and features, outputs, and model behavior may change over time as we improve the product.
• Use of de-identified data for improvement. We may use de-identified and aggregated data to improve the Service and our AI models, consistent with the Privacy Policy.
